AERATED WASTEWATER TREATMENT SYSTEM SERVICING AND MAINTENANCE AGREEMENT
Terms of Agreement
1. DEFINITIONS
1.1. This Agreement is made between Eco Septic (“Econocycle”) and the Customer.
1.2. The term “AWTS” refers to all wastewater treatment systems, including aerated and non-aerated wastewater treatment systems.
1.3. Eco Septic (“Econocycle”) agrees to provide servicing of the AWTS installed at the listed address in accordance with the manufacturer’s instructions and owner’s manual requirements.
1.4. The Customer agrees to pay to Eco Septic (“Econocycle”) any extra service or maintenance charges that may arise from general equipment failure or from the AWTS not being operated in accordance with the manufacturer’s operating instructions or owner’s manual. Consumables are at an additional cost.
1.5. By engaging our service, you acknowledge and accept the Terms of Agreement outlined herein.
1.6. Eco Septic (“Econocycle”) undertakes to service, maintain, and perform the necessary tests for the treatment plant and to send all relevant information to the local authority.
2. TERM OF AGREEMENT
2.1. This agreement shall commence from the date of commissioning or the first service by Eco Septic (“Econocycle”), or as mutually agreed between Eco Septic (“Econocycle”) and the Customer.
2.2. The term of this agreement is not fixed and shall remain valid until terminated in writing by either party, giving at least 30 days’ notice.
2.3. At its discretion, Eco Septic (“Econocycle”) may discontinue servicing of the system.
2.4. Eco Septic (“Econocycle”) shall attend the site during normal working hours four (4) times within a twelve (12) month period to perform scheduled servicing.
2.5. Eco Septic (“Econocycle”) may attend outside of normal working hours if emergency or remedial works are required to keep the system compliant with health, local government, or legislative requirements.
2.6. The interval between scheduled services shall be no less than two (2) months and no greater than four (4) months.
2.7. Eco Septic (“Econocycle”) reserves the right to issue updates to this agreement from time to time as required.
3. FEES
3.1. Four (4) services per annum are due quarterly and charged at the time of service at a fee of $110 per service inc GST, or as otherwise advised by Eco Septic (“Econocycle”) prior to service.
3.3. Fees payable by the Customer under this agreement must be paid within seven (7) days of receiving an invoice from Eco Septic (“Econocycle”).
3.4. At its discretion, Eco Septic (“Econocycle”) may temporarily suspend servicing until all outstanding fees have been paid in full.
4. SCHEDULED SERVICING INCLUSIONS
Upon each scheduled service, Eco Septic (“Econocycle”) shall perform the following:
4.1. Comprehensive servicing of the system in accordance with the manufacturer’s instructions.
4.2. Replenishment of disinfection tablets as required.
4.3. Provision of a service report to the Customer and relevant government bodies as directed.
5. SCHEDULED SERVICING EXCLUSIONS
The following work is not included as part of scheduled servicing:
5.1. Desludging of the sedimentation chamber (septic chamber).
5.2. Desludging of remaining chambers caused by the use of incompatible chemicals and/or products by the Customer.
5.3. Replacement of electrical components due to voltage fluctuations caused by the power supply authority.
5.4. Replacement of electrical components due to abuse or system neglect by the Customer leading to component stress.
5.5. Repairs or replacement of drainage, plumbing, pipes, and fittings associated with the system.
5.6. Any additional plumbing works required by the Customer not covered in preceding clauses will need to be sourced external to Eco Septic (“Econocycle”)
5.7. Effluent sampling if required post-commissioning and as requested by government bodies.
5.8. Repeat effluent sampling required by government bodies upon failure of effluent samples.
5.9. Damage caused by actions or inactions of the Customer, external forces such as acts of nature, or actions/inactions of third parties.
5.10. Clearing of blocked drains between the system and the dwelling.
5.11. Labour and/or components required due to system abuse or misuse by the Customer.
5.12. Replacement of components such as filters, air blowers, submersible pumps, control systems, electrical control units, suction transfer pumps, structural components, solenoids, or any other components of the AWTS.
6. DISTRIBUTION AREA
The Customer shall ensure the following actions occur as part of ongoing system maintenance between scheduled services:
6.1. Between services, the Customer may need to provide information regarding the condition of filters if a system fault occurs, to assist the service technician in determining the cause.
6.2. For above-ground distribution systems, if dripper/spray heads appear blocked due to residue, the Customer should contact Eco Septic (“Econocycle”) for rectification.
6.3. The Customer shall ensure the above-ground distribution area remains well maintained.
6.4. For subsurface distribution systems, the Customer must refrain from driving vehicles, storing heavy items, or carrying out groundworks within the allocated distribution area.
7. ACCESS
7.1. It is a condition of this agreement that the Customer provides Eco Septic (“Econocycle”) unrestricted access to the property for the purposes of scheduled servicing or unscheduled maintenance.
7.2. The Customer agrees to allow Eco Septic (“Econocycle”) suitable access to the system at all reasonable times as may be deemed necessary to carry out servicing and maintenance.
7.3. The Customer must ensure that all dogs and any other potentially aggressive animals (e.g. horses, cattle, etc.) are securely restrained or relocated prior to any scheduled service visit to allow safe and unhindered access for service personnel.
7.4. Failure to attend or provide access for a scheduled appointment, including no-show at site meetings, will incur a $45 rescheduling fee.
7.5. No access due to locked gates, missing or incorrect gate codes, or any other Customer-related issue preventing entry will incur a $45 rescheduling fee, in addition to the standard call-out fee or quarterly service fee applicable.
8. UNSCHEDULED SYSTEM MAINTENANCE
8.1. In the event of an unscheduled maintenance request by the Customer, the terms and conditions of this agreement apply.
8.2. The Customer will be charged in full unless the request arises as a result of a failure by Eco Septic (“Econocycle”).
9. INDEXED – CPI
9.1. This agreement is indexed to the Consumer Price Index (CPI).
9.2. Eco Septic (“Econocycle”), at its discretion, may adjust the service fee annually in accordance with the CPI and round the new fee amount up at its discretion.
